What does it apply to?  

Alaska’s political advertising laws regulate election communications disseminated through “the Internet.” (Alaska Stat. § 15.13.400(3),(6)).

What are the disclaimer requirements?  

In Alaska, all election communications must be clearly identified using the words “paid for by.” (§ 15.13.090(a)).

Online ads with a print or video component must display the following statement throughout the entire duration of the advertisement: 

“This communication was paid for by (person’s name and city and state of principal place of business). The top contributors of (person’s name) are (the name and city and state of residence or principal place of business, as applicable, of the largest contributors to the person.)” 

15.13.090(c)). Ads with a print or video component that are paid for by an outside-funded entity must also display the following statement throughout the entire duration of the ad: 

“A MAJORITY OF CONTRIBUTIONS TO (OUTSIDE-FUNDED ENTITY’S NAME) CAME FROM OUTSIDE THE STATE OF ALASKA.” 

15.13.090(g)).

Online ads with an audio component must include the following statement, read in a manner that is easily heard: 

“This communication was paid for by (person’s name). The top contributors of (person’s name) are (the name of the largest contributors to the person).”

Definitions for Alaska:  

 “Communication” means an announcement or advertisement disseminated through print or broadcast media, including radio, television, cable, and satellite, the Internet, or through a mass mailing, excluding those placed by an individual or nongroup entity and costing $500 or less and those that do not directly or indirectly identify a candidate or proposition. (§ 15.13.400(3)).

“Electioneering communication” means a communication that (A) directly or indirectly identifies a candidate; (B) addresses an issue of national, state, or local political importance and attributes a position on that issue to the candidate identified; and (C) occurs within the 30 days preceding a general or municipal election. Alaska Stat. (§ 15.13.400(6)).
